Terms of Service

By accessing or using Bobi ("the Service"), operated by MINDLINK TEC LTD ("we", "us", "our"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree, do not use the Service. These Terms apply to all users, including anonymous device users and registered account users.

These Terms are available in English and Chinese. In the event of any conflict, the English version shall prevail to the extent permitted by applicable law.

Bobi is an AI-powered image generation platform. Users upload photographs, select a visual style, and receive AI-generated stylized images. The Service operates on a credit-based system where each generation consumes a certain number of credits.

The Service is provided for personal, non-commercial use unless otherwise agreed in writing.

3.1 Age. You must be at least 13 years of age to use the Service. If you are between 13 and 18, you must have parental or legal guardian consent.

3.2 Anonymous Use. You may use the Service without registering an account. In such case, a device identifier and token are generated and stored locally to facilitate your use.

3.3 Registered Accounts. You may register via email, phone number, or WeChat. You are responsible for maintaining the confidentiality of your account credentials.

3.4 Accuracy. You agree to provide accurate, current, and complete information during registration.

3.5 Account Security. You are solely responsible for all activity occurring under your account. Notify us immediately at service@mindlink.tools of any unauthorized use.

4.1 Ownership of Uploaded Content. You retain all ownership rights to photographs and other content you upload ("User Content"). By uploading, you grant us a non-exclusive, worldwide, royalty-free license to use, reproduce, modify, and store your User Content solely for the purpose of providing and improving the Service (including processing through AI models to generate stylized images).

4.2 Ownership of Generated Content. You own the AI-generated images created through the Service. You may use them for personal or commercial purposes, subject to these Terms and applicable law.

4.3 AI Disclaimer. AI-generated content may be inaccurate, incomplete, or inappropriate. The Service does not provide professional advice, and generated content should not be relied upon as such. We make no warranties regarding the quality, accuracy, or suitability of generated content.

4.4 No AI Training. We do not use your User Content or generated images to train, fine-tune, or improve our AI models.

4.5 Responsibility. You are solely responsible for the User Content you upload and how you use generated content.

You agree NOT to use the Service to:

5.1 Generate, upload, or share content that: - Contains nudity, sexual acts, or sexually suggestive material - Depicts violence, gore, or self-harm - Contains hate speech, harassment, or discriminatory content - Depicts child sexual abuse material (CSAM) — zero tolerance - Promotes illegal activities or substances - Constitutes defamation or impersonation - Infringes any third-party intellectual property, privacy, or publicity rights

5.2 Upload photographs of another person without their express consent.

5.3 Use the Service for: - Automated or bulk generation through scripts, bots, or scrapers - Reverse engineering, decompiling, or attempting to extract source code - Circumventing credit limits, paywalls, or access controls - Testing the Service for vulnerabilities without authorization

5.4 Violation of this section may result in immediate termination of your access without refund of unused credits, and may be reported to relevant authorities.

6.1 Credits. Credits are non-refundable, non-transferable one-time purchase units consumed per image generation. The credit cost per generation is displayed before confirmation.

6.2 Validity. Credits are perpetual and do not expire, provided your account remains in good standing.

6.3 Pricing. Prices are listed in USD. We reserve the right to change prices at any time. Price changes do not affect credits already purchased.

6.4 Payment Processing. All payments are processed by Stripe, Inc. We do not store full credit card numbers or banking details. Your payment information is subject to Stripe's Privacy Policy.

6.5 Refunds. All credit purchases are final and non-refundable, except as required by applicable consumer protection law (including the UK Consumer Contracts Regulations). If you believe you are entitled to a refund, contact service@mindlink.tools.

6.6 Free Tier. We may offer a limited number of free credits for trial purposes. We reserve the right to modify or discontinue the free tier at any time.

7.1 The Bobi name, logo, brand, user interface design, visual style templates, and underlying prompts are the exclusive property of MINDLINK TEC LTD and are protected by applicable intellectual property laws.

7.2 You may not use our trademarks, logos, or trade dress without prior written permission.

7.3 Upon account deletion, you will no longer have access to your generated images through the Service. We recommend downloading any images you wish to retain before requesting account deletion.

8.1 Service "As Is". The Service is provided on an "as is" and "as available" basis without warranties of any kind, either express or implied.

8.2 No Guarantee. We do not guarantee that: (a) the Service will be uninterrupted, timely, or error-free; (b) AI-generated images will meet your expectations; or (c) any content will be stored indefinitely.

8.3 Limitation of Liability. To the fullest extent permitted by law, MINDLINK TEC LTD shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or relating to your use of the Service.

8.4 UK Consumer Rights. Nothing in these Terms affects your statutory rights as a consumer under the Consumer Rights Act 2015.

9.1 By You. You may stop using the Service at any time. To request account deletion, contact service@mindlink.tools. We will process your request within a reasonable timeframe (typically 30 days).

9.2 By Us. We may suspend or terminate your access if you violate these Terms, engage in prohibited uses, or if required by law. Upon termination for violation, unused credits are forfeited.

9.3 Effect of Termination. Upon termination, your right to access the Service ceases immediately. The following sections survive termination: 4.4, 5, 6.1-6.5, 7.2, 8, 9.3, 10, 11, and 13.

These Terms are governed by the laws of England and Wales. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts of England and Wales.

Nothing in this section prevents us from seeking injunctive relief in any jurisdiction.

We may update these Terms from time to time. Material changes will be notified via the Service (e.g., a notice on our website or by email). Your continued use after the effective date constitutes acceptance of the updated Terms. If you do not agree, you must stop using the Service.
